On Monday October 21st, 2024, Council ratified report BYL-24-06 which was presented at the Corporate Services Standing Committee on October 7th, 2024. The report outlined all of the findings from the internal project team, concerns related to a Short Term Rental By-law and licensing program, and options for the Committee and Council.
With report BYL-24-06 being received for information, the Town of Grimsby is not moving forward with a Short Term Rental By-law and licensing program.
Summary
Online platforms have led to a rise in Short Term Rentals (STR) across Canada and around the world. As a result of an approved motion (see below), Town of Grimsby Staff are facilitating public discussion with the intent of collecting feedback and investigating the possibilities of implementing a short term rental licensing program in the Town of Grimsby. With feedback from stakeholders and the community, Staff will work to create recommendations for Council to consider and determine the potential of a licensing program and STR By-law in the near future.
A STR licensing program protects the health and safety of people residing in residential properties, minimizes potential impacts to surrounding neighbourhoods, and protects the residential character of areas. In addition, a STR licensing program can attract tourism and investments while also increasing revenue to local businesses. It also provides a wider range of accommodation options for visitors.
We want to hear from you! We invite the public to share any initial questions and feedback using the forum below.
An Open House was held on June 20, 2024 and a livestream of the presentation is available on Youtube. A survey will launch in August.
Background
Presently, Bed and Breakfasts are permitted for certain properties in the Town of Grimsby Zoning By-law, but do not require inspections or licenses from the Town of Grimsby. STRs are not permitted in the Town of Grimsby. Municipal Law Enforcement Officers act on a complaint-basis only, and respond to reported issues such as parking infractions, excessive noise, and safety concerns.
Project Scope
On December 4, 2023, Town Council approved the following motion that defines the project scope:
"Whereas implementing a short term rental tax or licensing system within our municipality can aim to enhance both the regulatory framework for short-term rentals and the promotion of tourism.
Whereas such a system could ensure compliance with local regulations and contribute to the municipality's revenue stream.
Whereas revenue generated from this initiative can be allocated towards establishing a pilot project fund designated for legal representation for local tenants. This fund would be dedicated to providing legal representation and support services to local tenants facing housing-related legal challenges. The provision of legal aid for tenants will contribute to a more equitable and fair housing environment within our community.
Therefore be it resolved that staff conduct a comprehensive study on the potential implementation of a short term rental tax or licensing system and the establishment of the pilot project fund. The study should encompass an analysis of similar initiatives in other municipalities, potential revenue projections, administrative requirements, and the feasibility of allocating a portion of the revenue for tenant legal representation."

Why is the Town of Grimsby considering a short term rental licensing program?
The number of short term rentals are on the rise, and Town Council asked staff to investigate the potential of a short term rental licensing program. Your input will help inform the development of a draft short term rental By-law in Grimsby. Do you have questions or concerns about a STR licensing program? Share I have worked in the social services field for the last 26 years working with the homeless population. With the current housing crisis all over Ontario I can see and have seen people who are homeless or in shelters access B & B’s. Has the city considered how this will have an impact on the community. I do agree that it is good for home owners to supplement their income due to the high cost of gas, food, taxes etc. on Facebook Share I have worked in the social services field for the last 26 years working with the homeless population. Share I think short term rentals are much needed. As someone else stated it can supplement your income with the high taxes and mortgage rates and cost of living. Especially if you are single and only have one income coming into your house! On the flip side it is needed for many reasons. I used to do this through airbnb and the need was amazing. One gentleman came from Calgary to work here and stayed with me until he bought a house in Town and moved his family here. Many many people stayed with me while waiting for their new builds to be completed or the closing day for their house wasn’t the same as the house they sold. Some are just touring our beautiful Niagara Peninsula. Some are here for weddings etc. some have stayed with me for fundraisers in our area like the Iron Girl for Mcnally house hospice. Some could need a place to stay while visiting loved ones in hospice or hospital when they come from out of town. So so much need. Having said that, I would rather see owner occupied homes do this. When condos and other places are purchased only for the reason of short term rentals it can cause many issues, parties, unwanted guests, problems that could effect the neighbours who live there. Also there is already a shortage of housing for families so buying up only to rent out isn’t great. As far as the annual fee or liscencing, as long as it was reasonable and a way to stay on top of things would be fine. But remember people are already paying insurance and fees to airbnb. In the past I have also hosted med students doing placements in our wonderful hospital or with our family docs. Just my 2 cents on Facebook Share I think short term rentals are much needed. Share I don't see an issue with it. If there are already 120 what's the problem? I hear no complaints. With the cost of housing these days, why not make a little extra off your home? After all, it is our home. Hosting people from around the world who would love nothing but to spend time exploring the area under the roof of someone who lives here? Looks like a great fit to me. We stayed in an airbnb in Scotland. As tourists spent over $2k there. You don't see that sort of revenue beneficial to the town? It makes sense to me to allow it but for goodness sake don't make it impossible with burdensome fees. Make the money in return from tourists. Share Would this by-law allow property owners to rent out multiple rooms in their homes like a rooming house? Would there be a cap on the number of rooms allowed within a dwelling to be rented out? Will this by-law contemplate parking in the event multiple rooms are permitted to be rented at a time similar to a rooming house? Joe.S asked 11 months agoThe renting out of rooms would fall under a bed and breakfast, but require the serving of food to the guests. If those conditions were not met, it would not be defined as a bed and breakfast and not covered under this potential By-law.
As seen in other municipalities, a parking management plan could be mandatory under the application to ensure that there is viable parking on the property for all guests.
